General terms and conditions of

1. General
The following conditions apply to all contracts, deliveries and other services between YOIQI - Brief, Dubaschny & Wyen GbR and the buyer.

2. Offer and prices
All prices quoted are in euros and include VAT. Postage and packaging costs are added according to the separate payment terms. The prices from the online shop always apply.
Our offers and prices are fundamentally non-binding. The prices include the current statutory German VAT.

3. Contract
You can order from us on our website, by phone or by email. The purchase contracts are concluded when the order is accepted. The order is accepted either orally or in writing (usually via a confirmation email). In the case of written orders without specifying the payment method, we reserve the right to send the goods on delivery.
When ordering via the online shop, our terms and conditions apply when the order is sent and when the order is placed by telephone when the goods are received by the buyer.
Deviations due to individual agreements must be made in writing on both sides. Unless otherwise agreed in writing, our offers are generally non-binding with regard to execution, quantity, price, delivery time and delivery options.
After ordering, we reserve the goods exclusively for 10 days. If no payment is received by then, we reserve the right to offer the goods for sale again.

 

 


4. Delivery and shipping
In Germany, delivery and return within 14 days are free.
In other EU countries we charge a flat shipping fee for packaging, postage and insurance of the delivery of 6 euros.
For orders from Switzerland we charge a flat shipping fee of 15 euros. We do not cover any additional import costs (VAT, customs duties) incurred in Switzerland. Further information for orders from Switzerland.
If you want to order from outside the EU, contact us, we will make you an offer for the shipping costs.
Experience has shown that the delivery time within Germany is 1-2 days, in EU countries outside Germany 5-8 days.

5. Right of withdrawal / returns
You have the right to exchange the goods in perfect condition within 14 days of receipt without giving a reason, or to return them against reimbursement of the invoice amount. We are of course grateful for feedback on your order.
Washed, worn, used and damaged goods are excluded from the cancellation.

For returns from the EU, we will reimburse a flat rate of 6 euros for return costs. For returns from Switzerland, we can unfortunately only reimburse the value of the return. If the right of withdrawal is exercised lawfully, we will refund the value of the returned goods within 14 days.


6. Warranty
The warranty period is two years from delivery. In the event of complaints, the date of purchase must be proven with an invoice. The complained article must be sent to YOIQI - Brief, Dubaschny & Wyen GbR together with a copy of the invoice.
The warranty does not extend to normal wear and tear or willful destruction. The guarantee expires if you have changed the delivered goods.
We do not cover damage caused by incorrect cleaning, so please follow the washing instructions that you can find on the labels of the items.

7. Liability
We assume no liability for any damage caused by using the purchased products, especially if they are used improperly. Claims for damages are excluded.

 

 


8. Data protection

Your rights as a data subject

You can exercise the following rights at any time using the contact details of our data protection officer:

  • Information about your data stored by us and their processing,

  • Correction of incorrect personal data,

  • Deletion of your data stored by us,

  • Restriction of data processing if we are not yet allowed to delete your data due to legal obligations,

  • Objection to the processing of your data by us and

  • Data portability, provided you have consented to the data processing or have concluded a contract with us.

If you have given us your consent, you can revoke it at any time with effect for the future.

You can contact the supervisory authority responsible for you at any time with a complaint. Your competent supervisory authority depends on the state of your place of residence, your work or the alleged violation. Purposes of data processing by the responsible body and third parties

We process your personal data only for the purposes stated in this data protection declaration. A transfer of your personal data to third parties for purposes other than those mentioned does not take place. We will only pass on your personal data to third parties if:

  • You have given your express consent

  • the processing is necessary to process a contract with you,

  • the processing is necessary to fulfill a legal obligation,

Processing is necessary to safeguard legitimate interests and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data.

Collection of general information when you visit our website

When you access our website, information of a general nature is automatically recorded using a cookie. This is exclusively information that does not allow any conclusions to be drawn about your person.

DATA PROTECTION REGULATIONS FOR PAYPAL AS A PAYMENT METHOD

The person responsible for processing has integrated components from PayPal on this website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which are virtual private or business accounts. PayPal also offers the option of processing virtual payments via credit cards if a user does not have a PayPal account. If the person concerned selects “PayPal” as the payment option in our online shop during the ordering process, the data of the person concerned will be automatically transmitted to PayPal. By selecting this payment option, the person concerned consents to the transfer of personal data required for payment processing.

The personal data transmitted to PayPal are usually first name, last name, address, email address, IP address, telephone number, mobile phone number or other data that are necessary for payment processing. Personal data related to the respective order is also required to process the purchase contract.

The purpose of transmitting the data is to process payments and prevent fraud. The person responsible for the processing will transmit personal data to PayPal in particular if there is a legitimate interest in the transmission. The personal data exchanged between PayPal and the person responsible for processing may be transmitted by PayPal to credit agencies. On the basis of your expressly given consent, we will regularly send you our newsletter or comparable information by e-mail to the e-mail address you provided.

9. Final provisions
Should individual provisions of the contract between YOIQI - Brief, Dubaschny & Wyen GbR and the contractual partner, including these general terms and conditions, be or become fully or partially ineffective, this shall not affect the validity of the remaining provisions.
The completely or partially ineffective regulation is to be replaced by an effective regulation, the content of which comes closest to the purpose of the replaced one.
The validity of statutory law not waived or supplemented by these general terms and conditions remains unaffected.
